Welcome to our website

These Terms of Use (“Terms”) govern the use of this Site (defined below) operated by Local Treasures, unipessoal, Lda. By using our Site, you accept these Terms and agree to comply with them.

These terms may be modified and updated at any time, without prior notice. By using our Site and any services we may offer on the website, you agree to be bound by these Terms. However, the user is safeguarded by Decree Law 24/2014.

If you do not accept these Terms, you may not use our Site or any of our services.

1. Definitions

“User” means the visitor, user, customer who acquires/purchases activities/services and who accesses the Website.

Activities means all Experiences, Tours, touristic products or services sold on the website.

“External Suppliers” means tourism and activity suppliers who display their services and products on the Site.

“We”, “our” or “Algarve Treasures” means Local Treasures unipessoal, Lda., a Portuguese limited liability company.

2. About Us

This website is operated by Local Treasures Unipessoal, Lda, a Portuguese limited liability company registered in Loulé, Portugal, We have an office at Rua Batista Lopes, 32 R/C 8000-225 Faro, legal entity 514826223 and we operate with  RNAAT 708/2018 .

3. The Website

The Site displays activities and services offered and operated by Algarve Treasures

The Site also displays activities and services offered by Third-Party Providers who only use our online booking software.

External suppliers are displayed according to the activities they offer and how they fit into the Algarve Treasures concept.

You can find information about whether it is an activity provided and operated by Algarve Treasures or external suppliers in the individual file for each activity.

No:

(a) we exercise any control or authority over the Third-Party Providers, their employees, or representatives of the Third-Party Providers;

(b) we own or control the Third Party Provider’s products and services;

(c) we own any right, title or interest in the Third-Party Provider.

3.6 Reservations made in activities provided by External Suppliers are covered by civil, legal liability and other obligations inherent to the External Supplier's activity.

3.7 Algarve Treasures does not have any legal obligations when booking activities made with external Suppliers.

3.8 Information about the identity of the External Supplier can be found on the form prior to finalizing the reservation.

3.9 The contact details of external Suppliers will be informed and made available together with the activity voucher.

4. How to Book

When the user clicks on the booking engine link and navigates to a service and/or product from Algarve Treasures or an external supplier, the user will be redirected to the Algarve Treasures or external supplier's online booking window.

Algarve Treasures and External Suppliers will have separate Terms, Conditions and Privacy Policies, as indicated, which will apply to the user.

To book the desired activity, you must indicate: the number of adult participants and the number of children under 12 years old. Later in the booking process, you can specify in the “comments” section if there are any special needs, or implicit degree of limitation and the precautions that must be taken into consideration.

It is the user's responsibility to: correctly indicate the number of participants; number and age of participating children; the number of people with special needs (listed in the number of adults identified); lack of or incorrect information about the type of special need; the degree of limitation involved in the care of these individuals, as well as other information that is specifically requested in the activity form. If these circumstances are not met, Algarve Treasures and its External Suppliers reserve the right to not admit the participation of people in the activity who lack complete and necessary information for the adequate provision of the activity.

Refusal of access or incomplete enjoyment of our services, caused by insufficient or incorrect information provided by the customer at the time of purchase, will not give rise to any refund or other form of compensation for non-use of the service.

When booking an activity, the user is signing up to participate in a chosen activity at the time and place specified in the booking record. However, all activities have a minimum number of participants, so Algarve Treasures and its external Suppliers reserve the right to cancel the activity if this number is not reached or there are force majeure impediments that make it impossible to carry out the activity in security or in accordance with the contracted service.

The activity reservation only becomes effective after payment, that is, after the purchase has been completed. The user will then receive an email with information and confirmation of the activity.

If the minimum number of participants is reached with your reservation, you will immediately receive an email confirming your reservation. Otherwise, your reservation will appear as “Pending”.

In case of cancellation of a “Pending” activity, Algarve Treasures will inform the user by email (to the email address indicated in the customer registration).

5. During the Activity or Service

To enjoy the activity, the user must be present at the time and place indicated on the Voucher. The user must present the activity Voucher on paper or digitally to the activity organizer.

There will be no refund if the customer or user arrives late, considering the previously scheduled time and location informed for the activity (See refund policy)

There will also be no full or partial refund for anyone who is unable or unwilling to fully enjoy the activity, as well as many of the services included.

During the activity, the user must maintain civilized and respectful behavior towards the organizer of the activity and other people involved. Algarve Treasures reserves the right to remove from the activity any person who does not respect this behavior or shows signs of being under the influence of alcohol or other substances that could put the smooth development of the activity at risk.

Algarve Treasures is not responsible for any personal property that may be lost, forgotten or stolen. It is the responsibility of participants to keep their personal property safe during the activity.

6. Restrictions on use of the website.

By accessing this Site, the user agrees to the Terms, as well as our Privacy and Cookies policy. This Site is intended for use by persons over eighteen (18) years of age.

By using this Site, the user declares that:

(a) is at least eighteen (18) years of age;

(b) you have the legal authority to enter into binding legal obligations with Algarve Treasures or external Suppliers.

The User is prohibited from:

(a) use any robot, spider, scraper or other automated means to access the Site for any commercial purpose without express written permission by us;

(b) interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site;

All content displayed on the Site, including, without limitation, text, graphics, photographs, images and illustrations, is the intellectual property of Algarve Treasures, its licensors, external Suppliers, or Suppliers. All elements of the Site, including without limitation the general design and Content, are protected by trade dress, copyright, moral rights, trademarks and other laws relating to intellectual property rights. The Site can only be used for its intended purpose: to allow users to locate and make reservations for activities with Algarve Treasures or external suppliers.

The user may not modify any of the materials or copy, distribute, transmit, display, perform, reproduce, adapt, publish, license, create derivative works, transfer or sell any information or work contained on the Site. Removal of any copyright, trademark or other proprietary notices from material found on the Site is expressly prohibited.

All trademarks, service marks and trade names of Algarve Treasures used or displayed on the Site (including, without limitation: names and logos of Algarve Treasures and Suppliers) (collectively “Marks”) are trademarks of Algarve Treasures or its affiliates, partners, suppliers or licensors. . You may not use, copy, reproduce, republish, upload, post, transmit, distribute or modify the Marks in any way, including in advertising or publicity relating to distribution of materials on the Site without our prior written consent.

7. Privacy and Cookies Policy

In addition to these Terms, our Privacy and Cookies Policy also applies to your use of this Site, which sets out the terms under which we process any personal data (also called “personal information”) and information about cookies on this Site.

8. Cancellations

If the payment conditions are not respected, Algarve Treasures has the right to cancel the service, without the customer being entitled to any compensation and/or refund.

The cancellation conditions for experiences provided by Algarve Treasures or external suppliers can be found on the booking form for each activity.

9. Dispute Resolution

You must file any claim or cause of action under these Terms within one (1) year after the cause of action arises, or the claim or cause of action will be barred. In the event of any controversy or dispute relating to the use of the Site, you must attempt, promptly and in good faith, to resolve any dispute with us.

These terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) will be governed by and construed in accordance with the laws of Portugal.

The Algarve Consumer Conflict Arbitration Center, located at Avª. Outubro 5th, nº. 55, R/C Dtº. 8000-075 Faro, Portugal, has exclusive jurisdiction to resolve any dispute or claim arising out of or in connection with these Terms or their subject matter or formation (including non-contractual disputes or claims).
